Terms and Conditions

1. General

The following terms and conditions apply to all orders placed and all payments made by the customer (hereinafter referred to as ”you”) with DENTAKAY AĞIZ VE DİŞ SAĞLIĞI HİZMETLERİ LTD, 168912-5, hereinafter referred to as “Dentakay”, “us” or ”we”, at the Dentakay website, mobile website, or via telephone (jointly referred to as ”dentakay.com”).

By using dentakay.com and making a payment/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before completing your order.

Only persons 18 years or older, who are not under guardianship and, are not acting in a capacity of a company, can place an order/make a payment.

You may be paying on behalf of yourself, or you may partially/fully pay the treatment fee of a third party through dentakay.com. Along with the payment made, the patient code and information on whose behalf the payment was made must be fully and accurately registered by you.

The inclusion of any products or services on dentakay.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product or service at any time.

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on dentakay.com at the time you place your order.

DENTAKAY want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the dentakay.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

2. Making Payment

The payment options available to you are via dentakay.com virtual POS, SWIFT or Money order. For more information, please contact Dentakay customer service.

When you make your payment, a confirmation e-mail will be sent to you if you have specified your e-mail address. If you think that there is an inconsistency in the payment amount and patient information sent to you with the confirmation e-mail, you must notify us of your objections within 1 week. Otherwise, the amount notified to you in the confirmation e-mail will be credited to the relevant patient account. If for any reason an alternative action is required, a DENTAKAY representative will contact you regarding the issue.

3.Refund Policy at Dentakay Dental Clinic

Cancelation by the Patient
If the patient wants to cancel a course of treatment for which he/she has booked an appointment and be fully refunded all fees for treatment not yet performed; he/she gives Dentakay Dental Clinic a minimum of 24 hours prior notice.

In case the patient wishes to discontinue the treatment during his/her appointments, a notice period of 24 hours prior in this case only Dentakay Dental Clinic refunds only the amount paid for treatment that they did not receive.

If a patient is receiving any treatment that involves laboratory work and initial work has been carried out; if the patient is having crowns/bridges or a denture made, and the work has already been started or completed by the laboratory, a proportion of the fee taken on the preparation appointment will be kept to cover the cost of the laboratory invoice.

4. Exceptions of the Refund Process

No refund claims will be processed in the following conditions:
No refund after the patient finishes the dental treatment at Dentakay Dental Clinic. In case there’s postoperative complications occurred or a problem with the dental treatment and the patient doesn’t have a second visit to our clinic, we fix the problem according to patient’s case and we can only provide him/her with the accommodation based on Dentakay’s partnership hotels.

During the on-going treatment, if the patient decides to cancel his/her treatment, the money cannot be refunded for the performed work.

Negligence by a patient complicating treatment outcomes in case the patient has neglected oral hygiene instructions.

Failed treatment outcomes after treatment completion due to patient noncompliance or treatment modifications done at other clinics.

The patient is unhappy with the color that he/she chose during the appointment.

No refund for the patient who decided to discontinue the treatment after shaving the teeth for the finished work.

The patient will lose the warranty in case he had a dental problem and went to another dentist to do a major change without informing Dentakay Dental Clinic.

5. Payment methods

You can pay for your goods/services in various ways as set out below.

Credit card or debit card
You can enter your payment details at the time you place your purchase using a valid credit or debit card (VISA, Mastercard, American Express, Troy or Discover). The applicable amount will immediately be reserved on your card but will not be debited until the goods are dispatched. DENTAKAY reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the data of the purchaser is correct. We may refuse orders depending on the result of these checks.

Others
SWIFT or Money order. For more information, please contact Dentakay customer service.

You will receive a Confirmation e-mail. You have an obligation to provide a correct e-mail address and to inform DENTAKAY about the subject in case your e-mail address changes.

6. Our Liability

Nothing in these Terms shall exclude or limit DENTAKAY’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

DENTAKAY accepts liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

DENTAKAY is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

7. Severance

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

8. Ownership of rights

All intellectual property rights, such as trademarks and copyrights at dentakay.com remain with DENTAKAY AĞIZ VE DİŞ SAĞLIĞI HİZMETLERİ LTD, and its subsidiaries or licensors. Any use of dentakay.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of DENTAKAY.
